個人數據信托制度構建研究

摘要： 隨著數字時代的到來，個人數據價值越來越高,，個人數據安全問題愈發(fā)緊迫。當前,，個人數據保護存在隱私政策或用戶協(xié)議的合同困境、數據交易市場主體地位不平等以及數據權屬不明等問題,。為了破解交易市場中個人數據保護的困境,，引入信托制度具有可行性和獨特優(yōu)勢。通過引入第三方信托機構,，明確數據權屬,、個人數據信托制度的基本構成以及相關配套制度，構建個人數據信托制度體系,，推動數據權屬的法律界定,，以達到破解交易困境和保護個人數據權利的雙重目的。

Research on the construction of personal data trust system

Abstract： In the digital age, the value of personal data is increasing, and the security issue is becoming more and more urgent. In the trading market, there are some problems in the protection of personal data, such as the contractual dilemma of privacy policy or user agreement, the unequal status of the main body in the data trading market and the unclear ownership of data. In order to solve the dilemma of personal data protection in the trading market, the introduction of trust system and third-party trust institutions has the feasibility and unique advantages to achieve the purpose of protecting personal data rights. By clarifying the data ownership, the basic composition of the personal data trust system and related supporting systems, the personal data trust system system is constructed.It is conducive to solving data trading dilemma and promoting the legal definition of data ownership.

引言
黨的二十屆三中全會明確指出,，提升數據安全治理監(jiān)管能力。目前,，我國已經陸續(xù)出臺了《民法典》《數據安全法》《個人信息保護法》《生成式人工智能服務管理暫行辦法》等法律法規(guī),，但因整體表述過于原則,在個人數據保護方面作用有限。因此,，有學者將信托制度引入個人數據保護領域,，進而建立個人數據信托制度,。2021年，數據信托（Data Trust）被《麻省理工科技評論》列為全球突破性技術,。此后,，國內學者研究數據信托制度達到高潮。例如,，翟志勇較早提出數據信托作為一種數據治理的新方案［1］,；李智提出數據信托本土化的困境與實現路徑，法律通過設立信托機構的準入和監(jiān)管機制來保障第三方機構信任程度［2］,；魏遠山提出個人數據信托的類型抉擇問題,，認為建立獨立信托機構作為個人數據信托制度的關鍵［3］。國內相關成果注重研究制度的部分內容,，未從整體制度構建層面進行系統(tǒng)性把握,。本文試圖明確個人數據信托的概念、優(yōu)勢等內容,，探索構建個人數據信托制度體系,，為我國個人數據信托立法提供理論參考。
